HOME STAGING AGREEMENT AND CHECKLIST

This Agreement for Home Staging (“Agreement”) is entered into on DATE OF PURCHASE (Please refer to purchase receipt) and between HER Home Design LLC (“Company”) and CLIENT on behalf of (“Client”) the owner of the subject property Address (“Schedule Property”) for the rental and/or lease of furniture, home décor items and accessories.

This Agreement for home staging service and furniture rental will be effective by and between DATES (60 days) from the date of purchase. (Please refer to purchase receipt).

SERVICES TO BE RENDERED

Services to be rendered on DATES (48 hours).

HER Home Design LLC will provide a PACKAGE TYPE DETERMINED BY PRODUCT PURCHASED (see purchase receipt) for the property. This package is defined as a service that involves staging certain rooms within the property with accessories including furniture. HER Home Design LLC will stage six rooms in the home.

Staging appointments canceled within 24 hours of the agreed-upon time will be charged a $199 rescheduling fee.

PAYMENT FOR SERVICES

CLIENT will pay compensation to HER Home Design LLC in the amount of COST DETERMINED BY PRODUCT PURCHASED (see purchase receipt) for installation of staging inventory and two months (60 days) of furniture rental. A monthly fee of COST DETERMINED BY PRODUCT PURCHASED (see purchase receipt) will be due on the first day of each new month after 60 days of purchase.

Payment may be made via cash, check or credit card. Returned checks will incur a $40 fee. All credit card transactions will incur a 3.9% convenience fee. Credit card chargebacks will incur a $45 fee and result in an immediate lien being placed on the property to include all applicable additional design/admin time, court costs, attorney fees, lien fees, etc.

Late monthly furniture rental payments will incur at $50 per month late payment fee if not paid in full by the due date.

The total invoice amount is due and payable prior to the beginning of staging work.

If for any reason the house is removed from active listing for sale, HER Home Design LLC must be notified and we will remove inventory from the home. Due to the deeply discounted pricing on this project, home staging fees will not be prorated if the home sells prior to the conclusion of this agreement.

The rental agreement includes consultations, inventory rentals, pickup and delivery charges, home staging, and de-staging.

Late payments will be subject to a 3% penalty. HER Home Design LLC property will be removed after five (5) days of non-payment.

TERM/TERMINATION
The term of staging for this agreement is 60 days. On the 61st day, the monthly staging fee will automatically occur. This Agreement may be terminated by either party upon 15 days written notice to the other party.

MAINTENANCE OF FURNITURE AND ACCESSORIES

CLIENT is liable to take care of the Schedule property and maintain the furnishings in good condition and to ensure all items are returned to HER Home Design LLC in the condition received, excluding normal wear and tear.

CLIENT acknowledges that the scheduled property, furnishings and accessories are owned by HER Home Design LLC for display purposes only. The property should not be used in any other manner or for any other purpose.

CLIENT further acknowledges and agrees that the furnishings shall remain at the Property during the entire term of this Agreement and shall not be removed from the Property, except by HER Home Design LLC.

Inventory remaining on the property will be listed on the purchase receipt. Its replacement costs are the direct responsibility of the Client. All items are to be returned in the same condition as when placed; otherwise, retail replacement costs will be invoiced and due immediately.

All personal inventory items are for display purposes only and are not to be used, including all bedding, table linens, towels, etc. Inventory is not to be moved without written consent from the HER Home Design LLC.

INVENTORY RIDER

Please refer to Home Staging Agreement and purchase receipt for a complete inventory of items. HER Home Design LLC requires a three (3) day prior notice to remove inventory.

ENTIRE AGREEMENT

This Agreement contains the entire Agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written.

CLIENT AGREEMENTS

CLIENT AGREES TO THE FOLLOWING CONDITIONS:

[ ] Provide access/key to the home to HER Home Design LLC for the duration of the staging contract or until the home sells, whichever comes first. The staging contracts from start through the duration of the staging agreement.

[ ] Inventory installed in the home by HER Home Design LLC representatives will not be moved or removed by any third parties.

[ ] CLIENT agrees to refrain from any pest treatment while staging items are in the house.
[ ] CLIENT will not conduct painting or other house repairs while inventory is installed that could

damage or soil installed items while listing is in an active status.

[ ] CLIENT gives HER Home Design LLC permission to hang artwork on the walls. The holes on the wall will be filled by the HER team upon de-stage.

[ ] CLIENT agrees that window treatments from HER Home Design LLC may be used, but do not convey with the sale of the home. Realtor must document in the Multiple Listing Service.

[ ] CLIENT agrees to prohibit smoking around the property of HER Home Design LLC.

[ ] CLIENT agrees that any changes to the final staged property must be communicated to HER Home Design LLC within 48-hours of final staging. No feedback shall indicate approval and shall constitute that the client, CLIENT is completely satisfied with the staging project as it was left by HER Home Design LLC when it was installed.

APPLICABLE LAW

This Agreement shall be governed by the laws of Indiana.

INDEPENDENT CONTRACTOR

It is expressly agreed that the HER Home Design LLC is acting as an independent contractor and not as an employee in providing the services hereunder. The Company and the CLIENT acknowledge that this Agreement does not create a partnership or joint venture between them.

MODIFICATION OF AGREEMENT

Any amendment or modification of this Agreement or additional obligation assumed by either party in connection with this Agreement will only be binding if done in writing and signed by each party or an authorized representative for each party.

INSURANCE
Insurance on the rented property will be provided by CLIENT homeowner’s insurance policy for the duration that the items are staged in the home.

THEFT/BURGLARY DAMAGE TO STAGING PROPERTY

HER Home Design LLC requires a refundable damage deposit in the amount of 10% of the total staging contract until the contract is complete. This deposit can be held via a credit card or cash deposit. In the event of a theft/burglary situation where staging furniture and/or accessories are involved, CLIENT agrees to immediately replace at full retail costs all stolen and/or damaged property within 48 hours of the incident. CLIENT will pay HER Home Design LLC $150 per hour to restage the property back to its original condition.

CLIENT understands that HER Home Design LLC will NOT file an insurance claim to be reimbursed for stolen or damaged property. A lien will be placed on the property address if fees for damaged or stolen items are not paid within 48 hours of notification. All applicable fees for the lien including attorney fees will be paid by the CLIENT.

PHOTOS & PUBLICITY

The Client acknowledges that before and after photographs will be taken during the staging process and gives permission to the Company for use of these photographs in the appropriate advertising and marketing materials. Approval to take final photos indicates the client’s complete satisfaction of the staging project as it was left by HER Home Design LLC.

SEVERABILITY

In the event that any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.

HOLD HARMLESS

Client further agrees to release, indemnify and hold harmless HER Home Design LLC, its officers, employees, agents contractors and suppliers against any and all losses, liabilities, damages, injuries, expenses and claims (including reasonable attorney’s fees) of Client or any third party arising from entry onto the Schedule Property and/or activities as authorized by this agreement, whether caused by negligence or otherwise, including without limitation property damage and personal injury claims.

REMEDIES

In addition to any and all other rights a party may have available according to law, if a party defaults by failing to substantially perform any provision, term or condition of this Contract (including without limitation the failure to make a monetary payment when due), the other party may terminate the Contract by providing written notice to the defaulting party. This notice shall describe in sufficient detail the nature of the default. The party receiving such notice shall have three (3) business days from the effective date of such notice to cure the default(s). Unless waived by a party providing notice, the failure to cure the default(s) within such time period shall result in the automatic termination of this Contract.

COVID POLICY / GLOBAL PANDEMIC
Due to the COVID-19 crisis and global pandemic, CLIENT agrees that the property being staged will be vacant and free from construction during the home staging process. HER Home Design staff will be masked during the home staging process. If anyone needs to enter the property during staging CLIENT agrees those people will be required to be masked and will leave the space expediently so staging can continue. A $199 delayed staging fee will apply if the COVID-19 policy is not followed by CLIENT.
